تلقى الدكتور هيثم ابو سعيد (رئيس بعثة المجلس الدولي واللجنة الدولية لحقوق الإنسان إلى الأمم المتحدة في جنيف معتمدة من الأمم المتحدة إيكوسوك) من فريق قانوني تطوعي، سطر الحروف الأولى لإعداد إخبار قانوني، سيتم توجيهه لمدعي عام المحكمة العدل الدولية ومجلس حقوق الإنسان التابع للأمم المتحدة ولجنة التحقيق الدولية المستقلّة التابعة للأمم المتحدّة المعنية بالأرض الفلسطينية المحتلّة.
وأكد السفير أبو سعيد أن الادعاء وفق المادة (٥) وهي جرائم التي تدخل في اختصاص المحكمة
1- يقتصر اختصاص المحكمة على أشد الجرائم خطورة موضع اهتمام المجتمع الدولي بأسره, وللمحكمة بموجب هذا النظام الأساسي اختصاص النظر في الجرائم التالية :
أ) جريمة الإبادة الجماعية.
ب) الجرائم ضد الإنسانية.
ج) جرائم الحرب.
د) جريمة العدوان.
2- تمارس المحكمة الاختصاص على جريمة العدوان متى اعتمد حكم بهذا الشأن وفقاً للمادتين 121 و 123 يعرف جريمة العدوان ويضع الشروط التي بموجبها تمارس المحكمة اختصاصها فيما يتعلق بهذه الجريمة, ويجب أن يكون هذا الحكم متسقاً مع الأحكام ذات الصلة من ميثاق الأمم المتحدة.
وأشار مكتب السفير أبو سعيد أن التعاون مع هيئة المحامين وعلى رأسهم مدير مكتب الاردن والاقليم الأوسطي للجنة المحامي حسن الحطاب سيتولون مقاضاة إسرائيل مع تكليف المحامي الدكتور معن الاسعد رئيس اللجنة القانونية لدى المحاكم الدولية في اللجنة.
وأضاف الدكتور ابو سعيد أن القضية ستشمل النقاط التي تضمنت المسودة الأولية لجهة تصنيف الجرائم المرتكبة من السلطات والجيش الإسرائيلي، تحت عناوين رئيسة : جرائم الإبادة، الجرائم ضد الانسانية، جرائم الحرب وجريمة العدوان .
وختم البيان بالاشارة إلى أن هذه الأنواع من الدعاوى تُطلق للجم الاعتداء على المدنيين العزّل ولكبح جموح العسكر في قتل الاطفال والتنكيل بالنساء والذين لا ذنب لهم من أي جهة أتت، كما شدد على أنها لن تخرج من الإطار الدبلوماسي الذي يتعاون معه بشكل وثيق ووفق بروتوكولات فيينا.
Dr. Haitham Bou-Said (head of the delegation of the International Council and the International Commission for Human Rights to the United Nations in Geneva, accredited by the United Nations ECOSOC) received from a volunteer legal team the initials to prepare a legal notice, which will be directed to the Prosecutor of the International Court of Justice and the United Nations Human Rights Council. And the United Nations Independent International Commission of Inquiry on the Occupied Palestinian Territory.Ambassador Abu Saeed confirmed that the prosecution is in accordance with Article (5), which are crimes that fall within the jurisdiction of the court1- The Court’s jurisdiction is limited to the most serious crimes of concern to the entire international community. Under this Statute, the Court has jurisdiction to consider the following crimes:
A) The crime of genocide.
b) Crimes against humanity.
c) War crimes.
d) The crime of aggression.
2 - The Court exercises jurisdiction over the crime of aggression whenever a ruling is adopted in this regard in accordance with Articles 121 and 123 that defines the crime of aggression and sets the conditions under which the Court exercises its jurisdiction in relation to this crime.
This ruling must be consistent with the relevant provisions of the Charter of the United Nations.Ambassador Abu Saeed's office indicated that in cooperation with the Bar Association, led by the Director of the Jordan and Central Region Office of the Committee, Attorney Hassan Al-Hattab, they will undertake the prosecution of Israel, with the assignment of Attorney Dr. Maen Al-Asaad, Head of the Legal Committee at the International Courts in the Committee.Dr. Abu Saeed added that the case will include the points that included the initial draft in terms of classifying crimes committed by the authorities and the Israeli army, under the main headings: crimes of genocide, crimes against humanity, war crimes, and the crime of aggression.
The statement concluded by pointing out that these types of lawsuits are launched to curb attacks on defenseless civilians and to curb the military’s enthusiasm for killing children and abusing women who are not at fault, from whatever party they come from. He also stressed that they will not be removed from the diplomatic framework with which it cooperates closely and in accordance with the Vienna Protocols.
